The Senior Coalition of Berkeley Township and Holiday City South Homeowners Association, Inc., spearheaded by Michael Signorile (President of the Coalition, Holiday City South and Councilman for the 3rd Ward Berkeley Township), are moving forward with a lawsuit against Governor Murphy and the New Jersey Department of Health (“DOH”) seeking an affirmation of the rights of both age-restricted associations and their members living in Berkeley Township to be able to enjoy fundamental rights guaranteed under both the New Jersey and United States Constitutions.  
 
Mr. Signorile advised that the Senior Coalition of Berkeley Township will be represented by the Law Offices of Paul Leodori P.C. of Medford, NJ in this matter.  Additionally, Mayor Amato has offered his support as well as that of the Berkeley Township Mayor and Counsel by filing jointly with the Coalition.  Angelo Guadagno, Counsel President and 2nd Ward representative and Sophia Gingrich, 4th Ward representative are standing firm with the Coalition.  They each represent senior communities in Berkeley Township and understand the need for the senior communities to reopen.
 
Because of the Covid-19 pandemic, for more than a year, various Executive Orders have imposed upon seniors and their community’s prohibitively costly, unclear, and now irrational burdens upon the use of clubhouses, pools, and other amenities.  According to Mr. Signorile, his goal is to “Get our community, especially our seniors, sensibly back to managing themselves without Trenton imposing arbitrary rules that are not consistent with the Centers for Disease Control and Prevention (“CDC”) and plain old common sense.”  For example, numerous Executive Orders entered by the Governor have mandates for wiping down chairs, doors, and floors yet the CDC has recently “revised” the need for such guidelines while noting that the risk of contracting the virus from touching a contaminated surface was less than 1 in 10,000.  
 
Moreover, both the CDC and DOH have ignored the fact that more than 82% of New Jersey seniors have received a Covid-19 vaccination. This is especially unfortunate for senior communities and their members wanting to enjoy their outdoor pools in the upcoming months but are mandated by Trenton to develop elaborate and expensive protocols which clearly defy what the scientific community believes is actually necessary.
 
“I just want to bring some rationality to this pandemic’s irrationality” says Mr. Signorile.  “Certainly, this lawsuit will likely accelerate a much-needed public dialogue about Trenton dictating policies which, at this time, are simply punishing seniors for no good reason”.
